The Management Authority for the North-West Regional Program 2021-2027 issued Instruction no. 4/21.11.2023 on taking over the provisions of Ordinance 28/2023 in the activities carried out at the AM PR NV 2021-2027 level and completing the operational procedures.
Considering EC Decision no. C(2022) 7386 approving the "North-West" program for support from the European Regional Development Fund under the objective "Investments for employment and economic growth" for the North-West region of Romania, CCI 2021RO16RFPR008,
Pursuant to the provisions of GEO no. 122 of July 29, 2020 regarding some measures to ensure the efficiency of the decision-making process of non-reimbursable external funds intended for regional development in Romania, with subsequent amendments and additions, of Law no. 315 of June 28, 2004 regarding regional development in Romania, with subsequent amendments and additions, GEO no. 23 of April 12, 2023 regarding the establishment of simplification and digitization measures for the management of European funds related to the Cohesion Policy 2021-2027, Ordinance no. 28 of August 10, 2023 for the establishment of measures necessary to optimize the implementation process of projects financed from non-reimbursable external funds, of Regulation (EU) 2021/1060 of the European Parliament and of the Council of June 24, 2021 establishing common provisions on the European Development Fund regional, the European Social Fund Plus, the Cohesion Fund, the Just Transition Fund and the European Maritime, Fisheries and Aquaculture Fund and establishing the financial rules applicable to these funds, as well as the Asylum, Migration and Integration Fund, the Internal Security Fund and the Financial Support Instrument for Border Management and Visa Policy,
Taking into account the provisions Ordinance 28/2023 for the establishment of necessary measures to optimize the implementation process of projects financed from non-reimbursable external funds,
Considering the provisions of the operational procedures approved at the AM PR NV level,
Considering that, to date, the MySMIS2021/SMIS2021+ IT system is not operational for all the necessary steps,
Article 1 This Instruction is applied in order to carry out all the necessary stages for the projects submitted within the calls related to the 2021-2027 programming period, launched in the MySMIS2021/SMIS2021+ computer system, for which expenses will be declared and payment requests will be sent to the European Commission until the end year 2023 and for which the Management Authority for the North-West Regional Program 2021-2027, according to the specific attributions and in accordance with the provisions of OG 28/2023, ensures the progress through the MySMIS2014/SMIS2014+ computer system of the stages for which the MySMIS2021/SMIS2021+ computer system is not operational.
Art. 2. From the date of entry into force, this document comes to complete the provisions of the operational procedures applied by all the staff engaged at the AM PR NV 2021-2027 level, with the following mention:
Until the operationalization of all stages within the MySMIS2021/SMIS2021+ IT system, namely contracting, implementation, project monitoring, authorization and payment of expenses, management of related irregularities and aggregation of expenses in a form compatible with the standard formats regarding the declaration of expenses to the European Commission provided by the Regulation (EU) 2021/1.060,
Ensuring the running of all the necessary processes will be done by using the MySMIS2014/SMIS2014+ IT system.
Art. 3. Later, after the operationalization of the MySMIS2021/SMIS2021+ information system, AM PR NV 2021-2027, with the support of the SMIS coordination unit within the Ministry of Investments and European Projects, will transfer the information and documents related to the flows carried out through the MySMIS2014/SMIS2014+ information system to the MySMIS2021/ SMIS2021+, under the conditions established by the legislation in force at the time of the transfer.
Article 4 This Instruction enters into force on the date of its approval and is communicated to the specialized structures within AM PR NV 2021-2027 for compliance. At the same time, this Instruction will complete the provisions of the Beneficiary's Manual.
